WAYNAI PTY LTD — Privacy Policy

1. Who this policy covers

This policy applies to website visitors and newsletter subscribers; people who enquire, request a quote, or contact us by phone, email, form or social media; customers and their authorised staff; people whose information is supplied to us so we can deliver marketing services (for example, business contacts, website users, or callers to tracked campaign numbers); and suppliers, contractors and job applicants, where relevant.

If you are a customer, you remain responsible for your own privacy notices to your customers, website visitors and callers. We act as a service provider in relation to campaign and website data we process for you.

2. The kinds of personal information we collect

Depending on how you deal with us, we may collect:

  • Identity and contact details — name, business name, role, email, phone, address, ABN, and other details you give us.
  • Business and service information — industry, service areas, suburbs, websites, Google Business Profile details, advertising accounts, content, logos, photos, testimonials, and access credentials you provide so we can do the work.
  • Enquiry and contract information — quotes, orders, correspondence, approvals, complaints, and records of our agreement with you.
  • Payment and billing information — invoice details, payment status, and information needed to process invoices, bank transfer, card payments, or (if later introduced) a nominated payment or direct debit provider. We do not ordinarily store full card numbers or CVV in our own systems. Those details, if collected, are handled by the relevant payment provider.
  • Website and device information — IP address, browser type, device type, pages viewed, referring URL, approximate location derived from IP, cookie identifiers, and similar analytics data.
  • Marketing and campaign data — advertising identifiers, conversion events, form submissions, click and call attribution, suburb or service-level performance, and related reporting.
  • Call tracking data (where enabled for a customer campaign) — calling number, called number, time, duration, call recordings, transcripts, summaries, and related analytics.
  • Sensitive information — we do not seek sensitive information (for example health, racial or ethnic origin, religious beliefs, or government identifiers) as a routine part of our services. If campaign calls or customer content may include it, we will only handle it as reasonably necessary and as permitted by law.

We do not knowingly collect personal information from children for our own marketing. Our services are aimed at businesses.

3. How we collect personal information

We collect information directly from you (website forms, newsletter signup, email, phone, meetings, quotes and contracts); automatically when you use our website (cookies, analytics and similar technologies); from the customer who engages us, if you are that customer’s staff member, caller or website user; from advertising, analytics, hosting, CRM, call-tracking and similar platforms you authorise us to access; from publicly available sources such as your website, Google Business Profile, directories and social profiles, where reasonably necessary to deliver local marketing services; and from payment providers, professional advisers, or other third parties where it is unreasonable or impracticable to collect it from you and collection is permitted.

If someone else gives us your information (for example a business owner listing staff contacts), we expect that person to be authorised to do so.

4. Why we collect, hold and use personal information

We collect and use personal information to: respond to enquiries and provide quotes; enter into and administer contracts; deliver hyperlocal digital marketing, AI visibility / AI SEO, local SEO, Google Business Profile work, websites, Google Ads / SEM, social and content, citations, reviews support, and related services; obtain and use the access needed to do that work; set up and manage advertising campaigns and measure performance (calls, forms, booked jobs, suburb-level results); operate call tracking, recording, transcription and analysis where those features are enabled; process payments, manage accounts and recover amounts properly due; send service communications; send marketing or newsletters where you have subscribed or where permitted by the Spam Act 2003 (Cth) and you have not opted out; improve our website, systems and services; protect our business, customers and systems; and comply with law, court orders, regulators and professional obligations.

We will not use or disclose personal information for a purpose that is not related to these purposes unless you consent, you would reasonably expect it, or the law permits or requires it.

5. Cookies, analytics and our website

Our website may use cookies and similar technologies to operate the site, remember preferences, measure traffic, and understand how pages are used. You can usually control cookies through your browser. Blocking some cookies may affect site features.

We may use analytics tools (for example Google Analytics or similar) that collect device and usage data. Those providers may process data on servers outside Australia. See their own privacy notices for details. Our site may contain links to third-party sites. We are not responsible for those sites’ privacy practices.

6. Call tracking, recording and AI analysis

Where a customer’s quote includes campaign measurement, incoming campaign calls may be tracked and, where enabled, recorded. We will ordinarily configure an automated notice before recording, substantially similar to: “This call may be recorded and analysed for quality, training and marketing attribution purposes.”

Recordings and related data may be used for attribution, lead reporting, optimisation, quality, training, troubleshooting, dispute investigation and legal compliance. Where enabled, recordings may be processed by automated or AI systems for transcription, summaries, classification and recommended actions. Automated outputs can contain errors.

Customers must tell relevant staff that campaign calls may be tracked and recorded, and must tell us if those calls routinely involve sensitive information. Recorded lines should not be used to collect full card numbers, CVV, passwords or authentication codes.

A tracked number is subject to the telecommunications provider’s ownership and porting rules. After a campaign ends, tracking and recordings may cease and later be deleted under retention rules. Recordings are not a permanent archive.

7. Who we disclose personal information to

We may disclose personal information to our directors, employees and authorised contractors who need it to do their job; professional advisers; payment processors and, if we later appoint one, a nominated payment collection or direct debit provider; hosting, domain, email, CRM, analytics and software providers; advertising and platform providers you authorise us to use (including Google, Meta, Microsoft and similar); call-tracking and telecommunications providers; directory, citation and review platforms used in the services; a replacement provider nominated by a customer as part of an agreed handover; debt collection providers, where lawful and reasonably necessary for overdue accounts; banks, card networks and payment schemes in connection with payments or disputes; and courts, regulators, law enforcement or other parties where required or authorised by law.

We do not sell personal information. Where we use a service provider, we take reasonable steps to require them to handle the information consistently with this policy and Australian privacy law, so far as that is practicable.

8. Overseas disclosure

Some of our service providers and platforms store or process information outside Australia (for example in the United States or other countries where those platforms operate). If we disclose personal information to an overseas recipient, we will take reasonable steps required by APP 8, including considering whether the recipient is subject to a similar privacy regime or contractual protections. Platform terms (Google, Meta, Microsoft, analytics, hosting, AI tools) also apply. By using our website or engaging us, you acknowledge that overseas processing may occur where those platforms are used.

9. Direct marketing

We may send you information about our services if you are a customer, have enquired, or have subscribed. You can opt out of marketing emails at any time by using the unsubscribe link or emailing wayne@waynai.com.au. We will still send non-marketing service messages needed to administer an account or contract. We comply with the Spam Act 2003 (Cth) and, where relevant, the Do Not Call Register Act 2006 (Cth).

10. Security

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. Those steps may include access controls, multi-factor authentication where reasonably practicable, limited staff access, secure transmission where available, and contractual controls with providers.

No method of electronic storage or transmission is completely secure. You must also protect credentials you give us and tell us promptly if you suspect unauthorised access. If we become aware of an eligible data breach, we will assess and notify as required by the Notifiable Data Breaches scheme.

11. Retention

We keep personal information only as long as we need it for the purposes above, or as required by law (for example tax, company and contract records). When information is no longer needed, we take reasonable steps to destroy or de-identify it, subject to backup cycles and provider retention rules. Campaign recordings, analytics and platform logs may be retained for a shorter operational period and then deleted by us or the provider.

12. Access and correction

You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Email wayne@waynai.com.au with enough detail for us to identify you and locate the information. We will respond within a reasonable period.

We may refuse access or correction in limited circumstances permitted by the Privacy Act. If we do, we will explain why (unless it is unreasonable to do so) and how you can complain. We may need to verify your identity before giving access. We will not charge for making a request. We may charge a reasonable fee for giving access if the request is unusually onerous, and we will tell you first.

13. Complaints

If you have a privacy complaint, contact: WAYNAI PTY LTD, 38 Bellbird Ave, Burpengary East QLD 4505, wayne@waynai.com.au, 0466 503 449. Please include your name, contact details, and a description of the issue. We will acknowledge the complaint and aim to investigate and respond within 30 days.

If you are not satisfied, you may contact the Office of the Australian Information Commissioner: https://www.oaic.gov.au

14. Changes to this policy

We may update this Privacy Policy from time to time. The current version will be published at https://waynai.com.au/privacy. Material changes will be highlighted on the page or notified to customers where reasonably practicable.
